Who Needs to Complete This Form?
If you are a property owner or tenant hiring a contractor to perform work that qualifies as a capital improvement to your real property in New York State, you are required to complete and sign Form ST-124.
A capital improvement is an addition or alteration to real property that:
- Substantially adds to the value of the property or appreciably prolongs its useful life
- Becomes part of the real property or is permanently affixed so that removal would cause material damage
- Is intended to become a permanent installation
Common examples include new roofing, HVAC installation, plumbing or electrical work, additions, and permanent fixtures. All three conditions above must be met for the work to qualify.
Important:
This certificate cannot be used to purchase building materials exempt from tax. Both the customer and contractor must sign the completed form. The contractor is required to keep the original on file.
